Copyright and DMCA Policy
How to report content on a Bodek service that infringes your copyright, and how to dispute a removal.
On this page
Bodek Solutions LLC respects copyright. This Policy explains how to report material on a Bodek service that you believe infringes your copyright, and how someone whose material was removed can dispute it. It is part of the Terms of Service.
1. About this policy
Most content on the Services is stored or sent by our users, and we do not pre-screen it. We are not responsible for user content, but we respond expeditiously to valid notices under the Digital Millennium Copyright Act (17 U.S.C. § 512) and to comparable notices under other applicable law. This Policy is about copyright only; for other complaints see section 6.
Send notices to our designated agent: dmca@bodek.us. Email is the fastest route; if you need a postal address for service, ask at that address and we will provide one. We cannot act on an incomplete notice, and we do not give legal advice to either side.
2. Sending a notice
A valid notice must include all of the following:
- identification of the copyrighted work you say is infringed (or a representative list, if there are many);
- identification of the material you say is infringing, with enough detail for us to find it — the exact URL, share link, album, form, number or message, and the date and time where relevant;
- your name, mailing address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law;
- a statement that the information in the notice is accurate and that, under penalty of perjury, you are the copyright owner or are authorized to act on the owner's behalf; and
- your physical or electronic signature.
Misrepresentation has consequences. Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing — or that it was removed by mistake — may be liable for damages, including costs and attorneys' fees. Consider whether the use may be fair use before sending a notice.
A notice and the information in it will be passed to the person who posted the material, and may be passed to others as law allows, so send only information you are willing to have disclosed.
3. What we do with a notice
When we receive a notice that appears valid, we may remove or disable access to the material, disable a sharing link, album, form or number, notify the account holder with a copy of the notice, and keep a record of the complaint. We may act on a notice at our discretion and without determining the merits, and we may decline to act where a notice is incomplete, abusive or plainly without basis. Nothing in this Policy obliges us to restore material, to preserve it, or to mediate a dispute between you and another party, and our action or inaction is not an admission or a legal opinion.
4. Counter-notices
If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to dmca@bodek.us containing:
- identification of the material and the location where it appeared before removal;
- your name, mailing address, telephone number and email address;
- a statement that, under penalty of perjury, you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
- a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Bodek may be found) and that you will accept service of process from the person who sent the notice or their agent; and
- your physical or electronic signature.
We will forward a valid counter-notice to the person who sent the original notice. If they do not tell us within 10 to 14 business days that they have filed an action seeking a court order, we may restore the material.
5. Repeat infringers
We keep a record of notices we act on. Where an account is the subject of repeated valid notices, or where a single infringement is flagrant, we may suspend or terminate that account, its workspaces, links, keys and numbers, in appropriate circumstances and at our discretion. Termination under this Policy does not entitle you to a refund.
6. Other rights and complaints
For trademark complaints, impersonation, defamation, privacy or publicity complaints, non-consensual intimate imagery, or any other abuse, write to support@bodek.us (privacy requests about your own personal information: privacy@bodek.us). Tell us what the content is, where it is, who you are and what right you are asserting. Content that sexually exploits a child is removed and reported to the authorities as law requires.
